1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Prescrivia platform ("Platform"), operated by Prescrivia ("we", "us", "our"). By accessing or using our Platform, you agree to these Terms.
Prescrivia operates exclusively as an intermediary technology platform. We do not provide medical services, employ doctors, operate pharmacies, or sell medications.
2. Intermediary Status
Prescrivia is a technology intermediary that facilitates communication between patients, independent EU-registered doctors, and licensed EU pharmacies. It is essential you understand:
- We do not provide medical advice, diagnosis, or treatment
- All medical decisions are made independently by qualified doctors
- All medications are dispensed by independently licensed pharmacies
- We do not guarantee that any treatment will be prescribed
- We do not guarantee specific medical outcomes
3. Eligibility
To use the Platform, you must:
- Be at least 18 years of age
- Be a resident of a European Union member state
- Provide accurate and truthful information in your health assessments
- Have the legal capacity to enter into these Terms
4. Your Responsibilities
When using the Platform, you agree to:
- Provide truthful and accurate medical information
- Not misrepresent your identity or medical history
- Follow all instructions provided by the reviewing doctor
- Not share prescription medications with others
- Seek emergency medical care when needed — this platform is not a substitute for emergency services
- Keep your account credentials secure
5. Medical Assessment Process
When you submit a health assessment through our Platform, it is reviewed by an independent EU-registered doctor. The doctor may approve treatment, request additional information, or determine that treatment is not appropriate. The doctor exercises full clinical independence in making their decision.
6. Pricing and Payment
All prices displayed on the Platform are all-inclusive, covering the medical assessment, doctor review, prescription (if approved), medication, and delivery. Payments are processed through our secure, PSD2-compliant payment provider.
7. Refund Policy
If the independent doctor determines that treatment is not appropriate for you, you will receive a full refund of the platform fee. Once medication has been dispensed by the pharmacy, returns are generally not possible for safety and regulatory reasons, in accordance with EU pharmaceutical regulations.
8. Intellectual Property
All content, design, and functionality of the Platform are owned by Prescrivia and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Limitation of Liability
As an intermediary platform, Prescrivia is not liable for medical decisions made by independent doctors, medications dispensed by independent pharmacies, or medical outcomes resulting from treatment. Our liability is limited to the platform services we directly provide.
10. Governing Law
These Terms are governed by the laws of the European Union and the member state in which Prescrivia is established. Disputes shall be resolved in accordance with applicable EU consumer protection regulations.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
